TORONTO - A U. Trevor Booker Jersey .S. federal judge has ruled a subpoena can be issued compelling the former owner of the Vancouver Canucks to testify in a lawsuit arising from Todd Bertuzzis career-ending attack on Steve Moore. The Ontario Superior Court of Justice asked the U.S. court earlier this year to subpoena John McCaw Jr., who is based in Seattle, to testify in Toronto. Moores lawyer, Tim Danson, says he hopes McCaw will accept the rulings of the Ontario Superior Court and the United States District Court and appear as ordered at the trial slated to begin in September. Moore is suing Bertuzzi and the Canucks for $38 million for a 2004 on-ice hit that left Moore, then a Colorado Avalanche player, with a concussion and three fractured vertebrae. Danson had argued a jury should be able to hear McCaw answer whether he knew Canucks players were gunning for retaliation against Moore for a hit weeks earlier on former Canucks captain Markus Naslund that resulted in a concussion. Bertuzzi has alleged the Canucks then-coach Marc Crawford urged his players to make Moore "pay the price," while Crawford has claimed Bertuzzi disobeyed instructions to get off the ice before Moore was attacked. Danson has said NHL commissioner Gary Bettman and deputy commissioner Bill Daly have voluntarily agreed to testify. Danson has suggested that McCaw fostered a corporate culture that may have at least implicitly approved such an attack, including having as the president and general manager Brian Burke, who was "unapologetic about promoting violence in hockey." McCaw no longer owns the Canucks, having sold his company Orca Bay, now known as Canucks Sports and Entertainment. But he maintains a "very significant financial interest" in the outcome of the lawsuit, as he is still on the hook for half of any liability found against the team, which Danson said was a condition of the sale. HEROES That 70s Line – The Kings’ trio continued their torrid start with a big game against Columbus Sunday. C Jeff Carter and RW Tyler Toffoli both tallied a goal and three assists, while LW Tanner Pearson scored a pair of goals, in the Kings’ 5-2 win over the Blue Jackets. All had strong possession stats, but Pearson was best of the three (18 shot attempts for, 4 against, 81.8%). The line has scored 16 of the Kings’ 21 goals this season. See how they compare with the top three goal-scorers on other teams, none of which comprises a regular line like those in Los Angeles. As a percentage of total team goals (minimum a dozen goals), there isnt a threesome close to Pearson, Carter and Toffoli. ZEROES San Jose Sharks – Even though they had an impressive win in Anaheim Sunday, losing 2-1 on home ice, against Buffalo (!) Saturday can’t be ignored. While LW Patrick Marleau had a top-notch possession game (28 shot attempts for, 7 against, 80.0%), individually he generated one shot attempt (which missed the net) in 20:00 of ice time. In the aftermath of Kopitar’s injury, Jarret Stoll moved up to centre Dustin Brown and Dwight King. With Ryan Callahan and Alex Killorn hurting, Cedric Paquette was called up and inserted into the Tampa Bay lineup, but then RW Brett Connolly left Friday’s game against Winnipeg with a lower-body injury and is considered week to week, leaving Tampa Bay rather thin up front. FIRSTS Blackhawks G Scott Darling stopped 32 of 33 shots to beat the Ottawa Senators 2-1 Sunday.
